                WHEREAS, FRIENDSWOOD DEVELOPMENT COMPANY (hereinafter called “Friendswood”) _______________ that certain Declaration of Covenants, Conditions and Restrictions for Cypresswood Property Owners Association, Inc. dated July 10, 1978, (hereinafter called the “Declaration”) applicable to Cypresswood Section Seven and Cypresswood Section Eight, subdivisions of Harris County, Texas, which Declaration is filed for record under Harris County Clerk’s File Case No. F678313 and recorded under File No. 200-08-0882 is the official Public Records of Real Property of Harris County, Texas; and

 

                WHEREAS, under the terms of the Declaration, Friendswood reserved the right to add or assess additional land into said Association and make such land added or assessed thereto subject to the terms and conditions of the Declaration; and

 

                WHEREAS, Article V, Section 3 and 4 of the Declaration provides certain separate minimum square footage building requirements for dwelling units and separate minimum building line setbacks for front, side and rear property lines for Cypresswood, Section Seven and Cypresswood, Section Eight and Friendswood reserves the right to modify these ___________________________ for any additional lands made subject to the Declaration.

 

                NOW, THEREFORE, pursuant to the power reserved is the Declaration, Friendswood does hereby declare that:

 

1.                    The following described land (hereinafter called “Sold Land”) is hereby effect and averaged into the boundaries of the land averaged by the Declaration and is hereby subjected to the authority of the Cypresswood Property Owners Association, Inc., in accordance with the terms and conditions of the Declaration, to wit:

 

Cypresswood Section Eleven, a subdivision in Harris County, Texas, according to the plat thereof  recorded _________ ______, page 76 of the Map Records of Harris County, Texas

 

2.                    Minimum square footage requirements and the ___________ building lines setbacks set forth is the Declaration for Cypresswood Section Eight shall apply to said Land.

 

Except as specifically set forth herein, the Declaration is set modified or ___________ in any way and shall _________ in full force and effect in accordance with its terms.
